Acceptable Behavior

Guest agrees that all guests and invitees will observe all Terms & Conditions of this Agreement so as to maintain the premises in good order and appearance, and that all will conduct themselves in a manner that is respectful of neighbors and other guests on the property.

Air Conditioning

Each cottage is equipped with air conditioning.

Bikes

Bicycles are complimentary to all guests.

Cancellation Policy, Refunds & Travel Protection

We strongly recommend travel insurance through insuremytrip.com to protect against emergencies that may require a cancellation.

Check-In & Check-Out

Check-in: 3:00 PM. If possible, we can accommodate early check-in — call us from the airport to check availability.

Check-out: 11:00 AM. If the cottage is not needed for incoming guests, you may stay until 3:00 PM at no charge. For a guaranteed late check-out beyond 3:00 PM, there is a charge of 50% of your nightly rate — this must be confirmed before your arrival.

If your departing flight leaves after 8:00 PM, we highly recommend booking the late check-out option.

Check-Out Procedures

• Check-out time is 11:00 AM unless extended checkout has been arranged.
• Please wash all dishes before departure.
• Gather all laundry and leave it in a pile.
• Take all trash to the bins outside by the parking lot entrance.
• Leave keys inside the unit and lock the door behind you.
• Please leave the unit neat and orderly. Excessively dirty units may incur additional cleaning charges.
• Evidence of smoking inside any unit will result in a $200 deodorizing charge.

Cleaning Fee

A one-time mandatory cleaning fee is charged for each reservation. An initial set of toiletries is provided; additional items are the responsibility of the guest. The cleaning fee applies regardless of how clean the cottage is left.

Construction

Construction activity can occur at any time, as Kapaa is a rapidly developing area. We cannot provide refunds due to nearby construction noise.

Credit Card Authorization

By providing your credit card, you consent to its use without your original signature on the charge slip. This authorization cannot be revoked and will not terminate until 30 days after the premises are vacated. Charges may include, but are not limited to, damages beyond normal wear and tear.

Damages

Guest is responsible for any and all damages that occur to the units, premises, or any contents caused by guest or any member of their group during their stay. Any damage noticed upon arrival must be reported to Fern Grotto Inn immediately.

Indemnity & Liability

Fern Grotto Inn shall not be liable to guest, guests' invitees, or any third parties for damages arising from the guest's use of the premises. Guest agrees to indemnify and hold Fern Grotto Inn harmless from all claims, demands, or causes of action arising out of the guest's occupation of the unit.

Guest is liable for any damages to the unit or premises and for any injuries to persons caused by the conduct of guest and their invitees.

Keys

Keys are left inside the unit at check-in. Please leave keys inside the unit and lock the door at checkout.

Lost & Found

Items left behind after checkout will be held for 30 days. Contact us at 808-821-9836 or info@ferngrottoinn.com to arrange return shipping. Return shipping costs are the guest's responsibility.

Method of Payment

Noise & Disturbances

Guests and their invitees shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any unlawful purpose, nor violate any law or ordinance, nor commit waste or nuisance on or about the property.

Quiet hours: 9:00 PM to 8:00 AM daily. Please keep outdoor noise, music, and gatherings at a considerate level at all times.

Occupancy Limits

Each unit has a maximum occupancy as listed on the booking platform. Occupancy limits are strictly enforced. Additional guests beyond the stated maximum are not permitted without prior written approval and may result in immediate termination of the reservation without refund.

Parking

One designated parking space is provided per unit. No RVs, campers, or trailers are permitted on the property. Additional vehicles may only be parked with advance approval.

Pet Policy

Pets are not permitted at Fern Grotto Inn unless expressly approved in writing prior to booking. Unauthorized pets may result in immediate termination of the reservation and forfeiture of all fees paid.

Security Deposit

A $300 security deposit is required to confirm your reservation. The balance is due 90 days prior to arrival. Failure to pay the balance by that date will result in forfeiture of the deposit. If your reservation is made within 90 days of arrival, the full amount is due at the time of booking.

Severe Weather

Kauai weather is tropical and can be unpredictable. We do not issue refunds for canceled or shortened stays due to weather. Departures due to inclement weather do not warrant a refund of rent or deposit.

Smoking

Smoking is strictly prohibited inside all units. Smoking is permitted in designated outdoor areas only. Evidence of indoor smoking will result in a $200 deodorizing fee charged to the guest.

Telephone, Cable & Internet

High-speed WiFi is provided throughout the property at no additional charge. Cable TV is available in all units. International phone calls are not included and are the guest's responsibility.

Vacation Rental Tax

In addition to the nightly rates, a tax of approximately 13.42% will be applied to your total. Rates are subject to change based on current Hawaii state and county tax requirements.

Violation of Terms

Any guest or invitee who violates any of these Terms & Conditions may be immediately denied access to the premises at the sole discretion of Fern Grotto Inn, including but not limited to violations involving illegal substances, excessive noise, damage, or unauthorized guests or pets. No refund will be issued in such cases.

Attorney Fees

In the event that any legal action is commenced by either party arising out of this Agreement, the prevailing party shall be entitled to recover reasonable and necessary attorney's fees as fixed by the Court, in addition to all other relief at law or equity.
